These terms apply to all contracts concluded through oemcarplay.com between us and consumers and business customers. Deviating terms of the customer do not apply unless we agree to them in writing.
2. Conclusion of contract
The presentation of products in the shop is not a binding offer. By clicking the order button you place a binding offer to purchase. We accept it by sending an order confirmation or by dispatching the goods. If a product cannot be supplied, no contract is concluded and any payment is refunded in full.
3. Prices and payment
All prices are final prices in the currency shown for your market. The company is not currently registered for VAT, so no VAT is shown separately. Shipping costs are stated before you complete the order. We accept payment by debit and credit card and by PayPal.
4. Delivery
We ship to the European Union with a tracked courier. Stated delivery times are estimates and begin on dispatch. Unless expressly agreed otherwise, delivery takes place within 30 days of conclusion of the contract. If we cannot meet that period we will inform you and you may withdraw and receive a full refund.
5. Right of withdrawal
Consumers have a statutory right to withdraw within 14 days without giving reasons. Full details and the model withdrawal form are set out in our Right of withdrawal notice, which forms part of these terms.
6. Legal guarantee of conformity
The statutory rights of consumers in the event of a lack of conformity apply, with a liability period of 24 months from delivery under Directive (EU) 2019/771 as implemented in your country of residence. This is a legal right and is provided free of charge.
7. Right-fit guarantee
In addition to your statutory rights, we offer a commercial guarantee: if you send us your vehicle identification number (VIN) before ordering and we specify the wrong module, we refund the full amount including return shipping. This guarantee does not affect or limit your statutory rights.
8. Fitting and use
Our modules are supplied for self-installation or installation by a qualified workshop. Please follow the supplied instructions. Do not operate video functions while driving; observe the road traffic law of your country. Damage caused by incorrect installation or modification of the product is not covered by the commercial guarantee.
9. Retention of title
The goods remain our property until payment has been received in full.
10. Liability
We are liable without limitation for damage arising from injury to life, body or health, and in cases of intent or gross negligence. In cases of slight negligence we are liable only for breach of a material contractual obligation, and limited to the foreseeable damage typical of this type of contract. Statutory product liability is unaffected.
11. Applicable law and dispute resolution
Bulgarian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer resident in the European Union, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of residence (Art. 6 Rome I Regulation). We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
12. Severability
If any provision of these terms is or becomes invalid, the validity of the remaining provisions is unaffected.
